The terms that govern your use of the Monematics suite and website.

Risk warning

Trading in the financial markets carries significant risk. Margin-traded products and other financial instruments can lead to losses that exceed your deposit and may not be suitable for all investors. The Monematics Suite is a set of technical-analysis tools: it does not give investment advice, it does not make trading decisions for you, and past or hypothetical performance is not a guide to future results. You are solely responsible for your trading decisions. If you are in any doubt, seek independent financial advice before trading.

1. These terms

These terms of service ('Terms') govern your use of the Monematics indicator suite ('the Suite'), monematics.com ('the Site') and the licences we sell. By subscribing to the Suite or using the Site you agree to these Terms. If you do not agree, do not subscribe or use the Site. Monematics Ltd is a company registered in England and Wales (no. 17375549) at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ.

2. The service

The Suite is a set of self-optimising indicator files for use in the MetaTrader 4 and MetaTrader 5 trading platforms, delivered as a subscription. A subscription activates the Suite under a licence key issued to you. We may update the Suite, or add or remove features, from time to time. Some indicators may be offered on an experimental or early-access basis. Experimental indicators are provided for evaluation only: they may be incomplete, and can be changed, withdrawn or removed at any time without notice.

3. Your licence

Subject to payment and these Terms, we grant you a personal, non-exclusive, non-transferable licence to use the Suite on the number of accounts your subscription covers, at any broker.

  • Single licence: use on one account at any broker.
  • Triple licence: use on up to three accounts at any broker.
  • A licence is for your own use only. You may not resell, share, rent, sub-licence or otherwise make the Suite available to anyone else.
  • You may not reverse-engineer, decompile or attempt to derive the source code or internal workings of the Suite.

4. Age and eligibility

By subscribing to the Suite or using the Site you confirm that you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and that you have the legal capacity to enter into these Terms. If you are using the Suite on behalf of a company or other entity, you confirm that you have authority to bind that entity.

5. Accounts

To buy a subscription you create an account through our authentication provider. You are responsible for keeping your sign-in details secure and for all activity under your account. You must provide accurate information and keep it up to date.

6. Billing and payment

Subscriptions are paid in advance, in pounds sterling, through our payment processor Stripe. Subscriptions renew automatically at the end of each billing period until you cancel. Prices are as shown on the Site at the time you subscribe and may change for future periods.

7. Free trial

New accounts may take a 7-day free trial, once. During the trial you can use the full Suite without charge. At the end of the trial the applicable price is charged automatically unless you cancel during the trial. Trials are available to new customers only.

8. Cancellation, refunds and digital content

You can cancel your subscription at any time from your account area. Cancellation stops future payments; you keep access until the end of the paid period. Every subscription includes a 30-day money-back guarantee: if you are not satisfied, email us within 30 days of your first payment and we will refund it in full. We do not otherwise provide refunds for part-used billing periods, except where required by law.

  • The Suite is digital content supplied by electronic means.
  • If you give your express consent at checkout to the immediate supply of the digital content, and acknowledge that by doing so you lose your statutory right to cancel, you will not have a right to cancel the contract for that digital content once it has been supplied to you.
  • If you do not give that consent and acknowledgement, you may have a 14-day statutory right to cancel. In that case we will not supply the digital content until the cancellation period has ended, unless you ask us to.

9. Acceptable use

You agree to use the Suite and the Site lawfully and not to:

  • Use the Suite in any way that breaches the account limits of your licence.
  • Redistribute, resell or give away the Suite or its licence keys.
  • Use the Suite to commit fraud or for any unlawful purpose.
  • Attempt to interfere with the Site, the licensing service or the rights of other customers.

10. Intellectual property

The Suite, the Site and the Monematics name and marks are owned by Monematics Ltd and protected by intellectual property law. The methods by which the Suite operates are proprietary and confidential. Except for the licence granted in these Terms, you acquire no rights in the Suite or the Site. If you send us suggestions, feedback or ideas about the Suite or the Site, we may use them freely without any obligation to you, and to the extent you have any rights in that feedback you assign them to us.

11. Termination and suspension

We may suspend or terminate your access to the Suite and your account, without notice, if you breach these Terms (including the acceptable use rules in clause 9) or if we reasonably believe your use is fraudulent, or harmful to us, the Site or other customers. On termination for breach, your licence ends immediately and we may retain any amounts already paid. We may also end this agreement on 30 days' written notice. If we end the agreement for reasons other than your breach, we will refund any prepaid fees for the unused part of your billing period.

12. Not financial advice

The Suite is a set of technical-analysis tools. It is not investment advice, and nothing on the Site is a recommendation to buy, sell or hold any financial instrument. Trading in financial markets carries significant risk. You are solely responsible for your trading decisions.

13. Disclaimers

The Suite and the Site are provided 'as is' and 'as available'. To the fullest extent permitted by law, we give no warranties of any kind, express or implied, including that the Suite will meet your requirements, be uninterrupted or error-free, or produce any particular trading results. Past or hypothetical performance of any indicator does not predict future results.

14. Limitation of liability

To the fullest extent permitted by law, Monematics Ltd will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or trading losses, arising out of or in connection with your use of the Suite or the Site, even if we have been advised of the possibility of such loss. Our total liability to you in connection with these Terms, the Suite or the Site, whether in contract, tort (including negligence) or otherwise, is limited to the amount you have paid us in the 12 months before the event giving rise to the liability, or £100 if you have paid us nothing. Nothing in these Terms limits liability that cannot be excluded by law.

15. Indemnity

You agree to indemnify and hold harmless Monematics Ltd, its officers, employees and agents from and against any claims, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your use of the Suite or the Site, your breach of these Terms, or your violation of any law or the rights of any third party.

16. Third-party links

The Site and the Suite may link to or reference third-party websites, brokers or services. These are provided for convenience only. We do not control them and are not responsible for their content, and their own terms and privacy policies apply when you use them.

17. Changes to these Terms

We may update these Terms from time to time. If we make changes that materially affect you, we will make the updated Terms available on this page. Continued use of the Suite or the Site after changes take effect means you accept the updated Terms.

18. General provisions

  • Severability: if any part of these Terms is found to be invalid or unenforceable, the remainder continues to apply.
  • Entire agreement: these Terms are the entire agreement between you and us about the Suite and the Site.
  • Waiver: a delay or failure to enforce any provision of these Terms is not a waiver of it.
  • Assignment: we may transfer these Terms and our rights and obligations under them. You may not assign them without our written consent.
  • Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control.
  • Electronic communications: we may send you notices and information by email or through the Site, and these count as written notices.
  • No partnership: nothing in these Terms creates a partnership, agency or employment relationship between you and us.

19. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
